About your Personal Web
Space
With a Basic Internet Access
Account ($19.95 per month) Catskill On Line provides you with 2MB of server
space for web pages and images. Web Space is not provided with WebTV or our
Internet Starter package. If you go over the 2MB limit, you will be sent an
e-mail informing you that you have reach your allotted space, please delete any
files that you do not need.
If you'd like to purchase additional space
call the business office from 9:00am to 5:00pm at 800-444-9338. The cost for
additional server space is $5.00 per month for an additional 5MB.
If
you reach 4MB of files in your personal web space, you will be unable to upload
any additional information or make changes to existing web pages. Once you have
delete unneeded files so that you are below the 2MB level; you will again be
able to upload files.
Connection Time
(Non-Dedicated Dial-Ups)
CATSKILL ON LINE Non-Dedicated Dial-Up Accounts include
unlimited usage. This does not mean continuous connectivity. While you may use
your CATSKILL ON LINE account for as long as you like, we expect you to
disconnect the service when you are not using it. (This policy frees up
connections for users who need them, keeping busy signals at bay.) If you wish

Passwords
Your
password is the key to your security and to ours. We are not responsible for
your sharing or loss of a password. (We do insist on use of non-obvious
passwords that some users may be prone to forget; in that case we have
procedures for setting new passwords.) Unless our records indicate that your
account/files have been maliciously accessed-without such access being enabled
by you--you will be held responsible for all activity in your account or under
your login/password. For your protection and ours, we request immediate
notification if your password has been lost, stolen, or otherwise compromised.

E-Mail
Please note
that you have a finite amount of space for your e-mail. We allow up to 15MBs of
e-mail to be stored on our system. Once you approach this limit, we will
attempt to contact you, requesting that you download your e-mail.
Confidentiality
Because data transmitted over the Internet is considered
"insecure," clients are advised that if privacy or security is an issue, any
confidential transmissions, including e-mail, should employ some sort of
encryption. CATSKILL ON LINE has a secure server available for interested
parties, but otherwise it is the subscriber's responsibility to provide and
configure their own encryption.
Limitation of
Liability
Limitation of Liability CATSKILL ON LINE's services are provided on
an "as is, as available" basis and no warranty, express or implied, including
but not limited to those of merchantability or fitness for a particular
purpose, is made with respect to CATSKILL ON LINE or its services. In addition,
CATSKILL ON LINE makes no guarantee regarding availability of dial-up services,
connectivity or system functionality (including E-mail, Usenet,
etc.).
CATSKILL ON LINE is not liable for any costs or damages arising
directly or indirectly from the use of its Service, Technical Support, or the
Internet. You are solely responsible for evaluating the accuracy, completeness,
and usefulness of all services, products, and other information, and the
quality and merchantability of all merchandise provided through this Service or
on the Internet.
Please check with your local Telephone company to ensure that your
access number is a local call for you. Even though an access number shares your
general geographical region or area code, this number MAY NOT
necessarily be a local number to you. Substantial toll charges may apply to
numbers that you do not verify as local to your area and calling
plan.
Termination for Cause
All of the following actions are expressly prohibited and will
result in automatic termination of a subscriber's account:
* Sharing, or allowing use of your password by another
person or user.
* (Non-Dedicated Dial-up Accounts) Multiple
simultaneous logins from disparate locations in a user account.
* Attempting to gain access to another member's
account, whether or not the attempt succeeds.
* Use of the system in such a way as to willfully or
negligently burden our server's disk space, CPU, telecommunications or other
resources or to effectively use CATSKILL ON LINE's resources to cause a "denial
of services" for CATSKILL ON LINE clients or those connected to other systems
or servers on the network.
* Willful or malicious attacks on another system,
server, or client on the network.
* Any of the following forms of "SPAM":
* Willful or negligent disregard of the privacy and/or
autonomy of other users, notably by sending mail or audio messages to a user
who has expressly requested not to be contacted.
* Excessive cross-postings, or posting the same article
to several newsgroups, is prohibited.
* Automated unsolicited e-mailings (sending large
amounts of unsolicited e-mail), with either dedicated or non-dedicated
accounts.
* Compiling or use of "bots."
* Performing any act that is prohibited under common
law or the statutes or regulations of the City of New York, the State of New
York, the United States of America, or under any applicable international
convention.
* Publishing any material via CATSKILL ON LINE that
violates any applicable copyright, patent or trademark law or
convention.
* Publishing any material via CATSKILL ON LINE that
contains pornography or racism.
* Use of CATSKILL ON LINE's Dial-Up Account for
advertising or promotion of a commercial product or service (Excepting clients
with commercial accounts.)
* The use of electronic distribution lists or other
mass electronic mailings. Such use will result in immediate cancellation and a
$500 per incident cleanup fee.
Privacy
It may be
necessary for CATSKILL ON LINE employees to examine system accounting logs and
other records to resolve system problems. CATSKILL ON LINE reserves the right
to access an account's mailbox to resolve system problems or mail system
errors.
In addition, CATSKILL ON LINE will
cooperate with the appropriate legal authorities in investigating claims of
illegal activity, including but not limited to illegal transfer or use of
copyrighted material, postings or e-mail containing threats of violence, or
other illegal activity. CATSKILL ON LINE makes no guarantee and assumes no
liability for the security of any data on any server including "secure
servers."
Our customers are reminded that no
computer system should be considered safe from intrusion. E-mail may pass
through many computer systems, and should not be considered a secure means of
communication unless encrypted. (Even then, information is only as secure as
the encryption method.)
Miscellaneous
In
order to guarantee the integrity of client data, we recommend downloading all
mail from our mail server and backing up web pages and other files stored on
our server.
Non-enforcement or waiver of any
section of this agreement does not constitute consent or continuing waiver and
CATSKILL ON LINE reserves the right to enforce this agreement at its sole
discretion.
Accounts of subscribers filing for
or adjudged bankrupt, insolvent or engaged in winding up will be terminated
immediately upon notice of such status.
CATSKILL ON LINE is under the
jurisdiction of the laws of the state of New York and this agreement shall be
governed by the laws of the State of New York and is subject to the
jurisdiction of the courts of the State of New York.
If any paragraph or part of this
agreement is held to be unenforceable or invalid, the agreement shall remain in
force and effect and the invalid portion of the agreement shall be treated as
if omitted.
This agreement shall be made part
of but shall survive any other account or subscription agreement entered by the
parties hereto, unless otherwise specified. We reserve the right to amend our
rules, regulations and prices without prior notice. Whenever possible such
shall be posted 30 days in advance on the Web site
http://www.catskill.net, or in the event
of a material rule, policy or price changes, via e-mail or snail mail. Please
